BTE gegen weitere Factory Outlet Center

Zahlreiche Modehändler engagieren sich auf kommunaler und Landes-Ebene gegen die stetige Expansion von Factory Outlet Center (FOC) oder Designer Outlet Center (DOC). Denn obwohl die FOC/DOC ein Einzugsgebiet von oftmals 100 bis 200 km vorsehen, liegen etliche existierende und noch geplante Standorte der Ansiedlungsvorhaben zum Teil nur wenige Autominuten voneinander entfernt. Dazu zählen auch Outlet Center unmittelbar hinter der gemeinsamen Grenze z.B. in Frankreich, den Niederlanden oder Polen.

Vor diesem Hintergrund hat der BTE vor kurzem ein schon seit Jahren existierendes „Positionspapier zu den Auswirkungen von Factory Outlet Center auf den deutschen Textil- und Bekleidungsmarkt“ überarbeitet und aktualisiert. Damit zeigt der BTE die Auswirkungen von FOCs auf den Textil- und Bekleidungsmarkt in Deutschland auf, und zwar sowohl für den stationären Textileinzelhandel als auch für die Textil- und Bekleidungsindustrie.

Vor diesem Hintergrund hat der BTE vor kurzem ein schon seit Jahren existierendes „Positionspapier zu den Auswirkungen von Factory Outlet Center auf den deutschen Textil- und Bekleidungsmarkt“ überarbeitet und aktualisiert. Damit zeigt der BTE die Auswirkungen von FOCs auf den Textil- und Bekleidungsmarkt in Deutschland auf, und zwar sowohl für den stationären Textileinzelhandel als auch für die Textil- und Bekleidungsindustrie.

Aus den in dem Positionspapier aufgeführten Gründen spricht sich der BTE gegen die Ansiedlung weiterer Fabrikverkaufszentren in Deutschland aus! Angesichts der bereits bestehenden Flächenüberhänge im Textileinzelhandel, des Warenüberangebotes und des differenzierten Distributionsnetzes, sind weitere FOC abzulehnen. Jeder zusätzliche qm an Verkaufsfläche verschärft die bekannten Probleme einer Branche, in der viele Unternehmen aus Industrie und Handel ums Überleben kämpfen.

Der BTE erkennt dabei durchaus den aktuellen Strukturwandel, der zu der Ausbreitung von FOC geführt hat. Dieser muss sich aber vernünftig entwickeln und darf bewährte Vertriebskonzepte einer Branche nicht irreparabel schädigen. Und der Wandel muss innerhalb der geltenden wettbewerbsrechtlichen, städtebaulichen und baurechtlichen Rahmenbedingungen erfolgen.

Verkaufsdaten-Austausch: Kartellamt bestätigt BTE

In einem dem BTE vorliegenden Schreiben an einen bekannten Lieferanten der Branche hat das Bundeskartellamt aktuell die Warn-Hinweise des BTE bestätigt: Der Informationsaustausch zwischen Händlern und Lieferanten, die eigene Shops betreiben, kann einen Kartellrechtsverstoß darstellen, so das Bundeskartellamt in seinem Schreiben. Die Herausgabe von vollständigen Verkaufsdaten (Produkt und erzielter Verkaufspreis) sei kartellrechtlich kritisch zu sehen und geeignet, die wettbewerbliche Freiheit des Händlers zu beschränken.

Das Kartellamt fordert dann auf, von den Einzelhändlern nicht weiterhin die Übermittlung aktueller Verkaufsdaten mit Produkt und erzieltem VK zu fordern. Wie eine zeitversetzte Übermittlung zu bewerten ist, wird in dem Schreiben offen gelassen. Nach wohl überwiegender Meinung im Kartellrecht dürfte hier jedoch ein wesentlich geringeres juristisches Risiko vorliegen.

Falsche Daunenjacke: Urteil gegen Amazon

Auf Veranlassung des BTE hat die Zentrale zur Bekämpfung unlauteren Wettbewerbs am Landgericht München mit Erfolg einen Prozess gegen Amazon wegen der Verwendung des Begriffs „Daunenjacke“ für eine zu 100 Prozent aus Kunstfasern (Polyester) gefüllte Jacke geführt. Auch der Zusatz „Primaloft“ war nicht geeignet, eine Irreführung der Verbraucher auszuschließen.

Für die Richter wurde damit in der Werbung eine zur Täuschung geeignete Angabe über wesentliche Merkmale der Ware gemacht, so dass ein Verstoß gegen § 5 UWG vorlag. Das Landgericht München hat Amazon daher wegen Irreführung der Verbraucher zur Unterlassung verurteilt (Az  17 HK O 2290/17).

Archroma sign partnership with Carlin to promote color inspiration tools in France

Orderrunde: Saisonplanung weiter optimieren!

Anfang Juli starten die Berliner Modemessen. Neben der Sichtung von Trends sollten sich die Gespräche unbedingt um eine weiter optimierte Saison- und Flächenplanung drehen, die sich am Kundenverhalten orientiert. Das bedeutet, außerhalb des hochmodischen Bereichs die Liefertermine noch näher an die „Bedarfstermine“ der Käufer zu rücken und auch die Mengen- und Flächenplanung anzupassen.

Unbedingt erforderlich ist es zudem, sich ausreichend Nachkauf-Budgets freizuhalten. Denn nur so kann man kurzfristig auf neu aufkommende Trends und ggf. auch auf Wetterkapriolen reagieren. Speziell in der zweiten Saisonhälfte lässt sich erfahrungsgemäß bei vielen Lieferanten sehr preisgünstig Ware am Lager absortieren.

Neben diesen „Hausaufgaben“ sollten aber auch wichtige Zukunftsthemen behandelt werden, mit denen man Kosten senken und/oder Umsätze steigern kann. Im Folgenden zwei Beispiele vom BTE-Kongress „Fashion-Emotion 4.0“ Anfang Juni in Köln:

Speziell in der zweiten Saisonhälfte lässt sich erfahrungsgemäß bei vielen Lieferanten sehr preisgünstig Ware am Lager absortieren.

Neben diesen „Hausaufgaben“ sollten aber auch wichtige Zukunftsthemen behandelt werden, mit denen man Kosten senken und/oder Umsätze steigern kann. Im Folgenden zwei Beispiele vom BTE-Kongress „Fashion-Emotion 4.0“ Anfang Juni in Köln:

  • Bilddatenaustausch – Der Modehandel braucht für sein Marketing und die internen Abläufe digitale Bilddaten. Die für die Marktpartner sehr effiziente Plattform „Fashion Cloud“ hat zwar zuletzt einige bekannte Marken hinzu gewonnen, mit derzeit rund 280 angeschlossenen Brands gibt es aber noch viel Luft nach oben. Durch die „Verweigerer“ wird das Bilddaten-Handling im Handel unnötig verkompliziert und verteuert.
  • Digitale Regalverlängerung - Aktuell nutzen 19 Brands und rund 50 Modehändler die digitale Regalverlängerung von Fashion Cloud über die kostenfreie App „Clara“. Die App läuft weitgehend problemlos. Über 80 Prozent der so bestellten Waren werden nach Händlerangaben vom Kunden abgeholt, bei 60 Prozent kommt es dann sogar zu Zusatzverkäufen.

Fazit: Auf den anstehenden Messen und bei den nachfolgenden Orderterminen sollte ausreichend Zeit für solche Gespräche eingeplant werden!

They also must pass a facility inspection. To maintain their certification, they must pass quarterly testing to ensure that as laundry conditions change, such as water quality, textile fabric composition and wash chemistry, laundered product quality is consistently maintained. Re-inspection occurs every two to three years.

This process eliminates subjectivity by focusing on outcomes and results that verify textiles cleaned in these facilities meet appropriate hygienically clean standards and BMPs for hospitals, surgery centers, medical offices, nursing homes and other medical facilities.

Hygienically Clean Healthcare certification acknowledges laundries’ effectiveness in protecting healthcare operations by verifying quality control procedures in linen, uniform and facility services operations related to the handling of textiles containing blood and other potentially infectious materials.

Certified laundries use processes, chemicals and BMPs acknowledged by the federal Centers for Disease Control and Prevention (CDC), Centers for Medicare and Medicaid Services, Association for the Advancement of Medical Instrumentation, American National Standards Institute and others. Introduced in 2012, Hygienically Clean Healthcare brought to North America the international cleanliness standards for healthcare linens and garments used worldwide by the Certification Association for Professional Textile Services and the European Committee for Standardization.

Objective experts in epidemiology, infection control, nursing and other healthcare professions work with Hygienically Clean launderers to ensure the certification continues to enforce the highest standards for producing clean healthcare textiles.

In 2016, Borealis acquired leading German recycler mtm plastics GmbH, which is now a member of the Borealis Group. By leveraging their respective areas of expertise and decades of experience as a virgin polyolefins producer and “upcycler”, respectively, Borealis and mtm plastics are exploring new growth opportunities with joint forces.

A success story originating from this exploration is a recently completed pilot project with Henkel, the global leader for adhesives, sealants and functional coatings. The companies have worked to develop a new packaging solution based on recycled material for the Made-at-Home all-purpose glue bottle and cap, which Henkel is marketing under its well-known Pattex brand.  The aim was to replace the virgin plastic material traditionally used for this packaging with a recyclate-based resin. The resin, however, had to fulfil the diverse material demands for packaging of an adhesive product.

After extensive and joint application development, a new bottle was developed with the proprietary mtm product Purpolen® PE, a high-quality polyethylene regranulate produced by mtm at its facilities in Niedergebra, Germany. Value chain partner KKT Kaller Kunststoff Technik GmbH, a plastics processor also based in Germany, manufactured the bottles. For the three separate components of the adjustable applicator nozzle, which is used for both filigree and wide-area gluing, high-quality Purpolen® PP polypropylene regranulate produced by mtm was identified as the ideal solution. German plastic components manufacturer bomo trendline Technik GmbH produced the applicator nozzles.

The new Pattex Made-at-Home packaging solution successfully passed extensive application tests, including a three-month storage test and other tests of mechanical properties. It was launched on the European market in 2018.

Kreditkarte: Sonderkonditionen über EFG

Immer noch zahlen viele Textileinzelhändler Kreditkarten-Disagios von mehr als zwei Prozent. Gemäß einer aktuellen EHI-Umfrage werden kleinen und mittleren Fachgeschäften aktuell durchschnittliche Sätze bei VISA und Mastercard von rund 2,1 Prozent in Rechnung gestellt, selbst Disagios bis zu drei Prozent kommen noch vor.

Dabei lassen sich über die beim BTE angesiedelte European Fashion Group (EFG) in diesem Bereich leicht Kosten sparen. Über deren Kooperationspartner können Kreditkarten-Disagiosätze ab ca. 0,82 Prozent für private Kreditkarten von Mastercard und VISA realisiert werden. Reduzierte Transaktionsgebühren und Terminalmieten sowie Informationen, wie solche Vereinbarungen am vorteilhaftesten zu gestalten sind, sind weitere geldwerte Vorteile. Gegenüber den o. g. „Normalwerten“ ist da schnell ein Prozentpunkt gespart, was bei einem Kreditkartenumsatz von z. B. 80.000 EUR einer Summe von 800 EUR entspricht.

BTE: Sommer-Schluss-Verkauf erst ab 30. Juli

  • Moderater Start in die Reduzierungsphase

Obwohl die Umsatzentwicklung des Modehandels in den letzten Wochen - auch aufgrund hoher Vorlagen - gegenüber dem Vorjahr meist rückläufig war, blieb es bis Mitte Juni an der Preisfront noch vergleichsweise ruhig. Zwar gab es bereits erste „Sale-Ankündigungen“, nach BTE-Beobachtungen waren die Preisreduzierungen im breiten Markt aber mit 20 bis 30 Prozent Nachlass noch verhältnismäßig moderat. In der Außendarstellung beschränkten sich die allermeisten Häuser zudem auf eine vergleichsweise zurückhaltende Werbung im Schaufenster und zum Teil auf Mailing-Aktionen.

Der BTE rät dringend davon ab, bereits jetzt aktuelle Sommerware zu reduzieren oder dem Kunden werblich eine große Reduzierungswelle vorzugaukeln. Die Modebranche braucht im zunehmend härter werdenden Markt vielmehr eine ausreichend lange Phase mit regulären Preisen, um die notwendigen Erträge erwirtschaften zu können.

Das ist umso wichtiger, als die Kostenbelastung zuletzt eher zugenommen hat. Etliche Unternehmen haben in die Digitalisierung investiert und auch die Kosten für Werbung sind aufgrund der neuen Medien oftmals gestiegen. Und aktuell gibt es wenig Anzeichen, dass der Modehandel seine Kosten künftig problemlos senken kann. Schließlich dürfte auch die Personalkostenbelastung künftig wachsen.

Ohnehin läuft man nach Ansicht des BTE mit früher Sale-Plakatierung in die Irre. Bei normalem Witterungsverlauf wird im Mainstream-Markt frühestens in der zweiten August-Hälfte der Start in die Herbstsaison wirklich gelingen. Wer also jetzt schon mit breiter Reduzierungswerbung startet, kann in den nächsten zwei Monaten beim Kunden nur mit großen Anstrengungen neue sinnvolle Impulse setzen.

Hinweis: Ende und Höhepunkt der Reduzierungsphase bildet auch in dieser Saison wieder der Schlussverkauf, für dessen Start der BTE den 30. Juli 2018 empfiehlt. Erfahrungsgemäß wird dieser Termin auch von den Medien durch entsprechende Berichte begleitet und beschert der Branche kostenlose PR und zusätzliche Frequenz zum Abverkauf der Saison-Restware.

Lenzing Group, world market leader in specialty cellulosic fibers and Duratex, the largest producer of industrialized wood panels of the Southern Hemisphere, announce that they agreed on the terms and conditions to form a joint venture to investigate building the largest single line dissolving wood pulp (DWP) plant in the state of Minas Gerais, close to Sao Paulo, Brazil. This decision supports the backward integration and the growth in specialty fibers, defined in Lenzing’s corporate strategy sCore TEN.

Lenzing Group, world market leader in specialty cellulosic fibers and Duratex, the largest producer of industrialized wood panels of the Southern Hemisphere, announce that they agreed on the terms and conditions to form a joint venture to investigate building the largest single line dissolving wood pulp (DWP) plant in the state of Minas Gerais, close to Sao Paulo, Brazil. This decision supports the backward integration and the growth in specialty fibers, defined in Lenzing’s corporate strategy sCore TEN.

The joint venture will investigate the construction of a 450,000 t DWP plant, which is expected to become the largest and most competitive single line DWP plant in the world. Dissolving wood pulp is the key raw material for the production of Lenzing’s bio-based fibers. For the future operation, the two companies have secured a plantation of 43,000 hectares that will provide the FSC® certified biomass. The plantation is fully in line with Lenzing’s wood and pulp sourcing policy. The basic engineering and the application for required permits and merger clearances will now be started.

Lenzing will hold 51 percent of the joint venture which will operate the mill, while Duratex’s share will be 49 percent. The estimated cash investment by the joint venture for the construction of the DWP mill is expected to be somewhat above USD 1 bn (based on current FX rates, net of generic tax refunds and the outcome of the basic engineering study). The joint venture will supply the entire volume of dissolving wood pulp to the Lenzing Group. This step is an essential milestone in the group’s ambition to grow its specialty fibers business.
